Today marks the 17th day into the 107th Nebraska Legislature and COVID-19 liability protection has been an early focus for the Kearney Area Chamber of Commerce. “There are a few bills that have been brought to the floor but LB 139 is something that we are going to support.” Kearney Area Chamber of Commerce President Derek Rusher, “Senator Briese’s legislation will provide a safe harbor for businesses following public health guidance and provides liability protection for healthcare providers and facilities.”
At least 19 states and the District of Columbia have approved legislation about COVID-19 liability and some governors have also issued executive orders on protections. LB139 does not cover the businesses, schools, churches and other entities that are opening up and are not in compliance with health directives or engaging in gross negligence or willful misconduct. The legislation will try to balance protecting businesses and other public facilities and those with legitimate claims.
